Acceptable Use Policy (AUP) – Swift IT

1. Scope of Services This Acceptable Use Policy (“AUP”) applies to all services provided by Swift-IT BV, gevestigd te Koning Boudewijnlaan 20A, 3500 Hasselt, ingeschreven in de Kruispuntbank van Ondernemingen onder het nummer BE 1013.924.073, hereinafter referred to as “Swift IT”. This includes, but is not limited to, hosting services, server infrastructure, cloud services, email services, cybersecurity solutions, and IT management. This policy applies to all customers, users, and any third parties making use of Swift IT services.
2. Lawful Use All services must be used strictly for lawful purposes and in full compliance with all applicable laws and regulations, including but not limited to Belgian law, European Union law, the General Data Protection Regulation (GDPR), and applicable electronic communications and anti-spam regulations.
3. Prohibited Activities It is strictly prohibited to use Swift IT services for:
  • Hosting, distributing, or promoting illegal content
  • Sending spam or unsolicited communications
  • Phishing, fraud, or deceptive practices
  • Distribution of malware, viruses, or harmful software
  • Unauthorized access to systems or networks
  • Violations of privacy or data protection laws
  • Any activity that may harm, disrupt, or negatively impact Swift IT systems, infrastructure, or third parties
4. Customer Responsibility The customer is fully responsible for:
  • All content hosted, transmitted, or processed through Swift IT services
  • The actions of its users, employees, or third parties
  • The security of access credentials and systems
Swift IT does not assume responsibility for customer-generated content or misuse of its services.
5. Third-Party Infrastructure Swift IT may rely on third-party infrastructure providers for the delivery of its services. Customers agree to comply with any applicable policies of such third-party providers where relevant.
6. Monitoring and Detection Swift IT reserves the right to monitor usage of its services where necessary to ensure compliance with this AUP. Swift IT may investigate any suspected violations or abusive behavior in accordance with applicable laws.
7. Enforcement Swift IT reserves the right, at its sole discretion and without prior notice, to:
  • Suspend or restrict access to services
  • Terminate services or agreements
  • Remove or block content
  • Take any technical or legal measures necessary to prevent further abuse
In cases of serious violations, Swift IT may act immediately without prior warning.
8. Abuse and Reporting Swift IT maintains internal procedures to detect and handle abuse. Where required, Swift IT may cooperate with competent authorities and share relevant information in accordance with applicable laws.
9. Liability The customer agrees to indemnify and hold Swift IT harmless from any claims, damages, or liabilities resulting from:
  • Misuse of services
  • Violation of this AUP
  • Illegal or harmful activities conducted via the services
10. Service Protection Swift IT reserves the right to take any necessary action to protect the integrity, stability, and security of its network, systems, and services, including preventing overload or abuse.
11. Changes Swift IT reserves the right to modify this Acceptable Use Policy at any time. Continued use of the services constitutes acceptance of the updated policy.
